Drug Crimes

Drug crimes are still aggressively prosecuted in the State of California, and at the federal level, even with the movement towards decriminalization of the use of some drugs, and the changes in marijuana law. Individuals are still being prosecuted for the sale of drugs, especially methamphetamine, heroin, cocaine, fentanyl, and other prescription medications. If you believe you are under investigation for drug crimes, or you have been contacted by law enforcement, or you have been formally charged, you should contact a criminal lawyer today to discuss your concerns. Persons selling or growing cannabis without the appropriate licensing, can still be prosecuted as well. Persons accused of selling hallucinogens, including mushrooms and LSD, have been aggressively prosecuted by state and federal authorities.

With prescription drug overdoses on the rise, these types of cases are also being aggressively prosecuted in the Bay Area. Prescription drug prosecutions may involve Oxycontin or Vicodin. Felony drug charges can impact one’s ability to work, professional licenses, and can be a lifetime stain on your record. Even if you believe you are innocent, any involvement with drug sales or drug processing can form the basis for a drug conspiracy charge.

Our office has years of experience defending drug crimes. We have defended persons accused of the sale of marijuana, including persons arrested operating large marijuana grow operations and with many pounds of marijuana in their possession. We have also defended people accused of selling prescription pills, in cases that involved undercover police officers and drug stings. Prior to opening his own office, Mr. Sullivan worked extensively on methamphetamine cases, including conspiracy to distribute methamphetamine, and he also worked on a complex post-conviction case involving the sale of precursor chemicals.

Sometimes drug crimes can trigger federal prosecution. Those types of cases will require the review of many hours of videotape or audiotape evidence and there is the risk of severe and enhanced penalties. Even at the state court level, drug convictions can carry prison terms. Some drug cases may involve the extensive use of search warrants. Our office has experience litigating search and seizure motions before Bay Area judges in all types of criminal cases. We have argued and litigated motions to suppress, and motions to traverse and quash warrants. We have also challenged unlawful seizures by filing petitions for writ, asking the court of appeal to review the lower court’s decision, at the pre-trial stage.

Drug cases and investigations often involve other types of charges, such as firearms offenses, seizure of property and vehicles, and seizure of digital and computer evidence. Our office has experience defending firearms charges joined with drug charges, moving for return of seized property, and evaluating seized digital and computer evidence.

Mr. Sullivan helped me out during a very difficult time for me personally, and I am very satisfied with the outcome. He, unlike other attorneys that I spoke to, wasn't dramatic or falsely enthusiastic, and that was reassuring. He was savvy and realistic, experienced, a listener, flexible and affordable. D. Client
