Our office handles state licensing and administrative representation, related to, or arising out of pending criminal charges, including licensing matters before the California Department of Motor Vehicles and other California State agencies. We have many years of experience handling Department of Motor Vehicle APS hearings, negligent operator hearings, and other types of vehicle related investigations or actions against the licensee. We have filed petitions for writ challenging decisions of the DMV, and have conducted extensive and lengthy DMV proceedings, involving the calling of expert witnesses and cross examination of DMV witnesses.
We also handle professional licensing or investigatory matters involving the Board of Psychology, Board of Nursing, Medical Board, Bureau of Real Estate, Department of Insurance, and other state or local licensing agencies. We have experience defending Penal Code Section 23 motions brought against the licensee. A Penal Code Section 23 motion is one where the licensing agency can appear in criminal court and recommend suspension, restriction, or revocation, of a professional license.
We also handle administrative or licensing matters involving public safety personnel, such as firefighters, police officers, or paramedics. This may include appearing on behalf of clients before state and local commissions or agencies with oversight powers over the city or state employee. We are well versed in the Police Officer Bill of Rights and Firefighter Bill of Rights. These are basic procedural safeguards to protect public safety personnel. We have experience litigating privacy issues, including violations of Penal Code Section 832.7 on behalf of police officers.
We handle matters involving EMT/EMS and Emergency Medical Personnel in the City of San Francisco. These matters may involve hearings or investigatory interviews with Emergency Medical Services investigators. We have also worked with clients facing EMSA penalties or investigations at the state level. Most often for EMSA matters, the local fire department or local fire department union will have a contract providing for legal representation before the state EMSA board. We have worked cooperatively with union contracted lawyers as well to assist our clients with EMSA issues.
